Sagarathome does not provide nutritional information for the products either on the website or marked on the products, and does not guarantee the accuracy of any information thereof. We are not obliged to ensure that meals purchased from our website and consumed is in accordance with your particular dietary needs, preferences, or dislikes. We do not provide any guarantee that our products contain ingredients that you like and leave out the ones that you do not. Therefore, please make sure to always check the ingredients in the product on the website before purchasing and even after receiving them. Sagarathome.com Billing:
Sagarathome.com offer on-demand, “one-time order” meals You will be charged only for the order, and the cancelation or modification of the ‘one-time order’ will not be available unless the meals are cooked, provisioned or shipped. The status of the one-time order will determine whether you are eligible for refund/cancellation/modification.
Sagarathome.com may change, add, or remove existing offers from time to time. Price changes will be communicated in advance either through website updates or through the Notice section of this given Agreement. The Price changes will take effect from the next day on which the new notice is issued. By continuing the use of Sagarathome services after the effective date of the price change, you indicate that you accept the new price revisions. Please make sure that you stay updated and read any notification given on the website carefully.
You will be charged any applicable sales tax on your order according to the local and state laws.
You are fully accountable for all the activities that happen under your account and you agree to be held liable for all the charges incurred under it, depending on the terms of the Billing policy stated in this Agreement. Once you are liable for such charges, the liability will continue even after the termination of this Agreement policy.
YOU AUTHORIZE AND AGREE THAT SAGARATHOME AND/OR OUR THIRD PARTY PAYMENT SERVICE IS AUTHORIZED TO CHARGE YOUR PAYMENT METHOD (AS DEFINED BELOW) IN AN AMOUNT EQUAL TO THE “THEN-EFFECTIVE” RATE. THE AMOUNT CHARGED WILL CONSIST OF ANY APPLICABLE TAXES AND SHIPPING CHARGES. YOU PROVIDE US ACCESS TO CHARGE YOUR GIVEN PAYMENT METHOD FOR ANY ADDITIONAL SAGARATHOME OFFERINGS PURCHASED BY YOU ON DIFFERENT OCCASIONS OUTSIDE OF OR IN EXCESS OF YOUR EXISTING ORDER ALONG WITH THE APPLICABLE TAXES AND SHIPPING CHARGES. EVERY TIME THAT YOU USE THE SAGARATHOME, YOU RE-AFFIRM THAT YOU AUTHORIZE US TO CHARGE YOUR PROVIDED PAYMENT METHOD SPECIFIED IN THE AGREEMENT, AND TO APPLY ALL THE FEES AND CHARGES TO THE SAME.
ALL THESE TERMS ARE APPLICABLE FOR THE ‘ONE-TIME ORDER’ SERVICE. AS YOU PLACE ORDER WITH OUR SERVICE FOR THE FIRST TIME USING THE ‘ONE-TIME ORDER’ SERVICE, YOU OBLIGE TO FOLLOW THE PAYMENT OBLIGATIONS STATED ABOVE.
Food Substitution Policy:
Although Sagarathome expects to have sufficient inventory to fulfill your order, availability of the products may vary without any prior notice. Sagarathome is not responsible for the unavailability of the product due to popular demand, whether the product is still in production or discontinued due to some reason.
After orders are placed, Sagarathome reserves the right to add or use substitute ingredients arising from the unavailability of a particular item. Substituted food items may contain different ingredients or allergens than the item listed in the original order. So, please check the product ingredient information on the website for all Sagarathome offerings prior to consumption. Whether the item is new or improved, if you are concerned about any particular ingredient, you should ensure that it is safe for you.

Shipping:

Indemnification:

Governing Law & Jurisdiction:
This Agreement is formed in accordance with the laws of the state of New York and it is governed by the same, without regard to its conflict of laws rule.
Resolving Disputes-Arbitration:
A majority of customer concerns can be resolved quickly by calling our customer service department at (888) 410-0154. If the Sagarathome.com customer service department is unable to resolve a complaint to your satisfaction (or if Sagarathome has not been able to resolve the dispute with you informally) , we may agree to resolve the conflict or dispute through a binding contract or arbitration to avoid long in court sessions of general jurisdiction.
All disputes and claims that are made under or related to the Agreement (whether resulting from a contract, tort, or otherwise, and whether from the past, pre-existing, or future, and including statutory, consumer protection, common law, intentional tort, injunctive, and equitable claims) will be resolved either using small claims court or by individual arbitration in accordance or following the rules specified by American Arbitration Association (AAA). Unless you and Sagarathome decide otherwise, the hearing shall take place in the county of your billing address. The AAA Rulebook is available online at adr.org, or by calling the AAA at 1-800-778-7879.
You consent to arbitration on an individual basis. In any dispute or conflict, neither customer nor Sagarathome will be permitted to join or combine claims by or against other customers. No parties can arbitrate or otherwise participate in any claims as a representative, class member, or in a private attorney general capacity. If any provision of this arbitration agreement is found unworthy or ineffective, the unenforceable part will be deemed null and void and severed; however, the remaining arbitration terms shall be followed through with.
The arbitrator shall empower to grant whatever relief would be available under the court law. Any settlement adjudicated by the arbitrator shall be deemed final and all parties shall be bound by it. The Arbitration made after this process will be governed by the Federal Arbitration Act 9 U.S.C. sec. 1-16 (FAA).
Waiver & Severability:
No waiver by Sagarathome of any terms and conditions set out in this agreement shall be deemed a further or continuation of renunciation of rights of such terms and conditions. Any failure of Sagarathome to assert a right or provision under these Terms & Conditions does not institute a waiver of said right or provision.
If any provision of this Agreement is held by a court or under any jurisdiction to be invalid, illegal, ineffective for any reason, then such provision shall be eliminated or restricted to the minimum extent. This will ensure that the remaining provisions of this Agreement will continue to be in effect and stay valid within the laws.
Entire Agreement:
This Terms & Conditions Agreement & the Privacy Policy constitute the sole and complete agreement between you and Sagarathome.com.
It supersedes all prior and concurrent arrangements, representations, and agreements, in both written and oral form.
Notice:
Sagarathome.com may deliver a notice in written or digital form of this Agreement, including but not limited to, by means of electronic mail (email), a general notice on the site, or a written mail, delivered to you by first class U.S. mail to your address on record related to your Sagarathome.com account. You may send notices to Sagarathome.com at any time via email as available on the website.
Telephone Calls & SMS Text Messages:
As you register for an account on Sagarathome, you will be asked to provide a telephone number for records, so that we can communicate with you effectively. The same number will be used for shipping and to inform you about your transactions. If Sagarathome employes the use of text messages to communicate about your order, you will be asked to indicate your consent to such texts. We will not send any text without your consent.
